This is an application filed under Section 482 Code of Criminal Procedure, 1973 seeking grant of interim bail to the petitioner for a period of 6 months in RC -03(S)/2016/SC-III/ND, registered at P.S. CBI, SC-III, New Delhi under Sections 120B/302/307/398/201 of IPC, 1860 and sections 25/27 of Arms Act. 2.
Mr. Dubey, learned senior counsel for the petitioner states that the petitioner is in custody since 02.06.2017 and has undergone incarceration for a period of 7 years and 7 months. During the said period, the petitioner has never been enlarged on bail.

responsible for taking care of his elderly and ailing parents. 4.
It is further stated that the petitioner also needs interim bail for the purposes of preparing his defence.

The petitioner has been in continued incarceration for a period of 7 years and 7 months and as of today, is still an under trial prisoner. The allegations against the petitioner are yet to be proved.

I am of the view that the trial is not likely to conclude in the near future and the continued incarceration of the petitioner will be violative of Article 21 of the Constitution of India. Every accused has a right of a speedy trial. 7.
In this view of the matter, the application is allowed and the petitioner is directed to be released on interim bail for a period of 3 months in in RC - 03(S)/2016/SC-III/ND, registered at P.S. CBI, SC-III, New Delhi under Sections 120B/302/307/398/201 of IPC, 1860 and sections 25/27 of Arms Act subject to the following terms and conditions:
i.
The petitioner shall furnish a personal bond in the sum of Rs. 10,000/- (Rupees Ten Thousand Only) with one surety of the like amount to the satisfaction of the concerned Investigating Officer (IO); ii.
The petitioner shall provide his mobile number to the concerned IO, which shall be kept in working condition and switched on at all times. iii.
The petitioner shall also furnish his residential address and in case he changes his address, he will inform the same to IO concerned and this Court as also;
iv.
The petitioner shall not leave the country without permission of the competent Court during the bail period and surrender his passport, if any, at the time of release before the Jail Superintendent; The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
v.
The petitioner shall not indulge in any act or omission that is unlawful or that would prejudice the proceedings in pending cases, if any vi.
The petitioner shall prepare his defence evidence and will not take any adjournment in the trial, pending before the Sessions Court. vii.
Upon expiry of the period of interim bail, the petitioner shall surrender before the Jail Superintendent.

In view of the order passed today, in CRL.M.(BAIL) 1592/2024 , Mr. Dubey, learned senior counsel on instructions, does not press the bail application with liberty to file the same at an appropriate stage.
10. Granting the said liberty, the petition is disposed of.
