The petitioner is seeking initiation of contempt proceedings against the respondent /DCP North-East for the wilful disobedience of the directions of this Court dated 24.07.2024 in W.P.(Crl.) 2193/2024. 4.

None appeared on behalf of the respondent despite sending advance notice.

Suffice to state that the aforesaid criminal writ petition was disposed of with direction to the respondent No. 2 to decide the representation dated 10.06.2024 and 18.06.2024 and pass a reasoned order thereupon.

Learned counsel for the petitioners has pointed out that the notice dated 31.07.2204 was served upon the respondent to comply with the aforesaid direction but in vain.

On perusal of the record, it appears that the petitioner had brought to the fore alleged criminal activities being committed by two persons, namely Sh. Bharat Singh and Sh. Charat Singh, evidently showing that there were several FIRs that had been registered against them for alleged commission of offences in the nature of trespassing, causing grievous hurt and so on; and therefore the petitioner sought initiation of proceedings against the aforesaid persons under Section 47 of the Delhi Police Act.

It appears that representations/complaints of the petitioner dated 10.06.2024 and 18.06.2024 have not been considered by the respondent.

Be that as it may, in the considered view of this Court, although no action has been taken by the respondent, the present contempt petition cannot be entertained for the simple reason that such jurisdiction should be invoked sparingly and in exceptional cases. The petitioner has other efficacious remedy to proceed against the alleged criminal activities being carried on by the two persons. 10.
