% 18.01.2019 It has been submitted on behalf of either side that the costs as imposed vide order dated 21.08.2017 in terms of the order dated 09.01.2019 of this Court have been paid by the petitioner to the respondent. Submissions made on behalf of either side.

Taking into account however that there had been no compliance of the proceedings dated 21.08.2017 also by the petitioner in as much as the petitioner i.e. the plaintiff had been granted a last and final opportunity for P.E. subject to costs of Rs.10,000/- payable to the defendant with it having been directed that no further opportunity would be granted with it having been directed that the steps to place on record the additional document would be taken positively within a period of two weeks, which also apparently had not been taken. It is thus apparent that there exists no infirmity in the impugned order.
