The writ petitioner seeks the framing of an appropriate direction commanding the respondents to permit him to vend at an appropriate site that may be allocated.

As per the disclosures made in the writ petition, the petitioner contends that his name was originally included in a list of 628 street vendors which was prepared by the New Delhi Municipal Council ["NDMC"]. It is further alleged that he was forcibly removed by NDMC from the spot in question in 2016.

Before us, it was conceded that the spot at which the petitioner was vending, and more particularly near Gate No.1-7, Palika Bazaar, Connaught Place, New Delhi, falls in a "no-vending/no hawking zone" in terms of the Urban Street Vendors Scheme, 2007 framed by the NDMC.

for directions being framed enabling him to continue to vend at Connaught Place, in light of the undisputed facts which emerge from the record and have been noticed hereinabove, we find ourselves unable to grant or accede to that prayer.

However, and notwithstanding the above, we leave it open to the writ petitioner to apply for a vending license in respect of any other permissible zone and where activities of such nature are permitted. Any application if so made may be considered and disposed of by the competent authority in accordance with law. 6.

Subject to the aforesaid observations, this writ petition shall stand disposed of.
