This petition is filed on behalf of the Petitioner under Section 11(6) of the Arbitration and Conciliation Act, 1996 ('1996 Act') seeking appointment of the Sole Arbitrator.

Disputes having arisen between the parties out of the Letter of Award issued to the Petitioner on 26.08.2014 for civil works at DDU Hospital. The Agreement was terminated by the Respondent on 28.04.2016 and performance guarantee was forfeited. Petitioner filed Civil Suit No. 108/2017 before the District Judge (South West), Dwarka Courts in 2017, which was disposed of on 24.07.2024 in light of an application filed by the Respondent under Section 8 of 1996 Act, whereafter the present petition was filed.

Learned counsel for the Respondent does not dispute the existence of the arbitration clause 25 of GCC and in light of this, Court finds no ARB.P. 1371/2025 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. impediment in appointing an Arbitrator.

Accordingly, this petition is allowed. Coordinator, Delhi International Arbitration Centre ('DIAC') is directed to appoint a Sole Arbitrator to adjudicate the disputes between the parties. Arbitration proceedings will be held under the aegis of Delhi International Arbitration Centre (DIAC) and as per its Rules. Fee of the Arbitrator shall be as per the DIAC (Administrative Cost and Arbitrators' Fees) Rules, 2018.

Learned Arbitrator shall give disclosure under Section 12 of the 1996 Act before entering upon reference.

It is made clear that this Court has not expressed any opinion on the merits of the case and all rights and contentions of the respective parties are left open.
