CM. No. 18140/2018 (for delay) This is an application filed by the applicant / petitioner seeking condonation of 50 days delay in re-filing the petition. For the reasons stated in the application delay of 50 days in re-filing the petition is condoned.

W.P.(C) 4716/2018 Present petition has been filed by the petitioner with the following prayers:

"It is therefore, most respectfully prayed that this Hon'ble

Court may graciously be pleased to:

(i) Issue writ, order or direction in the nature of mandamus directing the respondents to de-seal the above said factory / premises bearing Plot No. 121 situated at Khasra No. 122, Main Road, Village Mandoli, Delhi - 110093 for the period of one day only, in the interest of justice, (ii) Issue any other writ, order or direction which this Hon'ble Court may deem fit and proper on the facts and circumstances of the case in favour of the petitioner; (iii) Award cost of the petition to the petitioner (iv) Any further order / direction may kindly be passed in favour of the petitioner and against the respondents which this Hon'ble Court may deem fit, just and proper in the facts and circumstances of the case.

Mr. Gaurang Kanth, learned counsel appearing for the respondent no.2 / EDMC states, sealing has been effected in view of the order passed by the Supreme Court in the case of M.C. Mehta v. Union of India. He states, appropriate for the petitioner is to approach the Supreme Court even for desealing of the property. On this, learned counsel for the petitioner seeks to withdraw the petition to approach the Supreme Court.

The petition is dismissed as withdrawn.
