The present petition has been filed under Section 528 BNSS, 2023 seeking quashing of FIR No.100/2025 under Section 290/106, BNSS registered at Police Station Roop Nagar, Delhi and all consequential proceedings emanating therefrom, on the ground that the parties have arrived at a settlement.

Issue notice. The learned APP for the State accepts notice. 3.
The petitioner as well as respondent nos. 2 to 4 are present in Court and they have been identified by learned counsel appearing on behalf of petitioner, as well as, by investigating officer Mr. Raman Kant, PS Roop Nagar.

The brief facts of the case are that due to some mis-happening Ravi Kumar, the son of the respondent no.2 & husband of the respondent no.3 got injured due to the failing of earth/soil on him, while working at construction site and thereafter he was taken to the hospital where he was declared dead. This led to the registration of present FIR.

During pendency of the proceedings, due to intervention of family, parties have arrived at a settlement, terms whereof were reduced in writing in the form of settlement agreement dated 24.05.2025. 6.
It is a term of the settlement between the parties that the petitioner has already paid a sum of Rs. 1,50,000/- to respondent nos. 2 and 3 and further agreed to pay a sum of Rs. 4,50,000/- to respondent nos. 2 and 3 at the time of quashing of FIR. It is stated that the entire amount of Rs.6,00,000/- has already been paid by petitioner no.1 to respondent no.2 and 3. 7.
The receipt of full and final settlement amount of Rs.6,00,000/- is acknowledged by the respondent nos.2 and 3, who are present in court. 8.
The respondent nos.2 and 3, on a query posed by the Court, state that they have no objection in case the FIR is quashed. 9.
In view of the fact that the parties have arrived at a settlement, no useful purpose will be served in continuing the proceedings, rather the same would create further acrimony between them.

It is, thus, in the interest of justice that the present FIR and all the other proceedings emanating therefrom be quashed. 11.
Consequently, the petition is allowed and the FIR No.100/2025 under Section 290/106, BNSS registered at Police Station Roop Nagar, Delhi and all consequential proceedings emanating therefrom, is quashed. 12.
The petition stands disposed of in the above terms. 13.
