The present petition has been filed under Article 226 of the Constitution of India read with Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking issuance of Writ in the nature of Habeas Corpus, directing Respondent No.1 to produce the wife of the petitioner before this Court.

When the matter was taken up on the late date of hearing i.e. 03.09.2025, the learned Standing Counsel was directed to file a Status Report and Ms. "S", the wife of the petitioner, was directed to appear through video conferencing.

Pursuant thereto, Ms. "S", wife of the petitioner, is present through video conferencing from Police Station Chanditala, West Bengal. asked, she submits that she is about 21 years old and does not want to go back to her husband and is not under any coercion or pressure. 4.

Since her such statement is coming from safe and secured environment i.e. a Police Station and team of Delhi Police is also present at said Police Station, there is nothing to disbelieve her.

Since she is major, she is at liberty to stay wherever she wants and no further orders are required to be passed in the present petition. 6.

Accordingly, the present petition is hereby dismissed. 7.

All pending applications also stand disposed of in aforesaid terms. 8.

The petitioner is, however, always at liberty to take recourse to any other judicial remedy, as available under law.
