% 31.01.2017 The petitioner has filed the present petition under Article 226 of the Constitution of India for issuance of a writ of Habeas Corpus. Husband of the petitioner is missing since 16.01.2016. Respondents No.4 to 7 were named as suspects. This Court had issued notice to respondents No.4 to 7 as well. Various status reports have been filed. Polygraph test has been carried out on respondents No.4 to 7. However, as per the status report, the same did not reveal any deceptive response.
As noticed in the order of 25.07.2016, the version of Delhi Police is that the missing person had borrowed money and is in debt, and it is possible that he may be concealing himself. This was, of-course, disputed by the petitioner. We may also notice that the investigation of this case was transferred to the District Investigation Unit, North in July, 2016. However, till date, the whereabouts of the missing person are not known.
Learned counsel for the State submits that sincere efforts would continue to be taken to trace the missing person. We may note that various status reports have been placed on record including the last status report was filed on 27.01.2017 detailing the steps taken to trace the missing person. Counsel for the State submits that the petitioner would continue to be informed every two months the steps being taken to recover the missing person. The writ petition, as prayed, is disposed of, binding the State to the aforesaid statement made by its counsel.
