O R D E R

RFA 332/2017 & CM APPL.11871/2017 Parties have settled their disputes. The report of the Delhi High Court Mediation and Conciliation Centre has been received. The settlement agreement dated 4th January, 2018 is taken on record. The Court has perused the terms of settlement. The same are lawful. There is no impediment in accepting the settlement. As per the settlement, a sum of Rs.5 lakhs has to be paid by the Appellant to the Respondent.

A sum of Rs.10,87,000/- already stands deposited in this Court. It is directed that Rs.5 lakhs be released in favour of the Respondent. The remaining amount alongwith all the interest which has accrued on the deposited sum be refunded to the Appellant. In view of the matter having been settled, refund of court fee under Section 16 of the Court Fee Act is directed.

The appeal is disposed of as settled. Parties shall remain bound by the

terms of the settlement. The impugned judgment and decree is modified as per the settlement terms.

Let the matter be listed before the Registrar for release of cheques in favour of the Appellant and Respondent on 26th February, 2018.

Appeal and applications stand disposed of.
