The present petition seeks following reliefs: "a) Call for the records pertaining to the impugned remand orders dated 06.08.2025, 16.08.2025, 20.08.2025, 24.08.2025, 26.08.2025 and 28.08.2025 passed by the learned Magistrate, Patiala House Court, New Delhi, in FIR Nos. 473/2024 (Special Cell), 181/2025 (Special Cell), 264/2020 (Special Cell), and 37/2020 (Special Cell); b) Set aside and quash the impugned remand orders to the extent that they authorize or extend the Petitioner's police custody, as being contrary to Section 187 BNSS, 2023 and violative of Article 21 of the Constitution of India;

c) Issue a direction to Respondents that no request for remand of the Petitioner to police custody shall be made, entertained, or granted, unless it is accompanied by proof of registration of a specific FIR against such accused, and unless reasons of necessity are placed on The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

d) Direct that the Petitioner be forthwith remanded to judicial custody in accordance with law, and that no further police custody be sought or granted in the absence of fresh material and compelling special circumstances strictly scrutinised by the Magistrate; e) Pass such further orders or directions as this Hon'ble Court may deem fit and proper in the interest of justice."

Counsel for the Petitioner, on instructions, states that since as per the status report filed by the State, the Petitioner is no longer wanted in FIR No. 473/2024 (Special Cell) and is now in judicial custody in other cases, he does not press prayers (a) and (b).

As regards prayers (c) and (d), counsel for the Petitioner submits that, as per the status report in FIR No. 37/2024, the Petitioner is not specifically named and his implication is premised only on disclosure statements. He further submits that, in the remaining FIRs referred to in the status report, the Petitioner is either not named, acquitted, released, or is facing a pending trial. On this basis, he contends that any request for remand to police custody ought necessarily to be founded on a duly registered FIR and supported by reasons demonstrating necessity. Accordingly, he makes a request for directions to be issued in prayers (c) and (d). 4.

Mr. Amol Sinha, ASC for the State, on the other hand, submits that the Petitioner is implicated in several FIRs. He points out that, in FIR No. 37/2024, the Petitioner has been chargesheeted under Section 174A of the Indian Penal Code, 1860, and he has also been chargesheeted in FIR No. 181/2025. Mr. Sinha further submits that the prayers sought in the present petition are highly omnibus in nature and such directions cannot be issued. He adds that, in any event, any request by the State for police custody would necessarily have to comply with the requirements of law. In view of the above, no directions are required at this stage. 6.

Needless to state, any action by the State seeking police custody of the Petitioner shall be strictly in accordance with law and subject to satisfaction of the statutory requirements.
