Dr.Bhardwaj, learned counsel for the respondents, states that he has received some documents from the Department only this morning which indicate that efforts were made to ascertain the exact date of death of Shri Ram Singh, husband of the petitioner.

The documents handed over by learned counsel for the respondents, are taken on record. As per the documents gathered by the respondents, the date of demise of Shri Ram Singh was 6th February, 1996. The documents show that the name of the petitioner's mother was 'Smt.Chanderwati' and she was also known as 'Smt.Angoori Devi'. He states that efforts had to be made to verify the exact name of the mother of the deceased since in his service record, her name was recorded as 'Smt.Chanderwati' whereas in the Death Certificate filed in the present proceedings, her name has been mentioned as 'Angoori Devi'.

Now that the relevant information has been gathered by the respondents, they are directed to re-open the case of the deceased, Ram Singh and examine whether the impugned order dated 15th December, 1996, of removal from service, is sustainable in the light of the fact that Shri Ram Singh had expired prior thereto, on 6th February, 1996. Needful shall be done in a time bound manner, preferably within a period of three months from today. Thereafter, immediate steps shall be taken by the respondents to release the family pension and all other entitlements payable to the petitioner upon the demise of her husband.

Needless to state that if the petitioner is aggrieved by the order passed by the respondents, she will be entitled to seek her remedies as per law. 5.

The petition is disposed of in the above terms along with the pending application with no orders as to costs.
