The present application has been filed under Section 151 of the Code of Civil Procedure, 1908 ("CPC"), seeking extension of time to comply with the order dated 04th September, 2025.

Learned counsel appearing for the petitioner submits that the present petition had been filed assailing the Notice of Demand dated 12th December, 2024, issued by the respondent under Section 100(1) of the New Delhi Municipal Council Act, 1994 ("NDMC Act").

By the impugned Notice of Demand, the respondent had raised the demand of Rs. 72,23,325/-, in respect of petitioner's Flat No. 811, Ansal The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

It is submitted that vide order dated 04th September, 2025, the present petition was disposed of, with direction to the petitioner to deposit a sum of Rs. 35,00,000/-, towards partial demand with the respondent, within six weeks, i.e., on or before 16th October, 2025. Upon such deposit, the respondent was directed to issue a fresh notice to the petitioner in terms of Section 72 of the NDMC Act. There was a further direction not to take any coercive action against the petitioner.

By way of the present application, the Power of Attorney holder, Mr. Deepak Sarin, i.e., the son of the petitioner, submits that the petitioner has expired on 01st October, 2025, in United States of America ("USA"), where she was residing with her son and was battling cancer. Thus, by way of the present application, the Attorney Holder, Mr. Deepak Sarin, is seeking an extension of twelve weeks, from 16th October, 2025, to comply with the directions of this Court to deposit the amount in terms of the order passed by this Court.

Issue notice. Notice is accepted by learned counsel appearing for the respondents.

Learned counsel appearing for respondent-NDMC submits that the present writ petition itself had been filed on the basis of the Power of Attorney. He, thus, submits that there is no ground for extension of time. 8.

Having heard learned counsels appearing for the parties, and considering the facts and circumstances of the case, the time period for depositing the amount of Rs. 35,00,000/-, in terms of the order dated 04th September, 2025, is further extended for a period of twelve weeks, with The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

effect from 16th October, 2025.

However, it is clarified that in case, the requisite amount is not deposited within a period of twelve weeks, from 16th October, 2025, the protection as granted by the order dated 04th September, 2025, shall automatically lapse, and the NDMC shall be at liberty to take action, in accordance with law.

With the aforesaid clarifications and directions, the present application is accordingly disposed of.
