Present writ petition has been filed seeking a direction to respondent no.1/Registrar of Co-operative Societies to appoint an Inspection Officer and Inquiry Officer under Sections 61 and 62 of Delhi Co-operative Societies Act, 2003 (DCS Act) for the alleged embezzlement and fraud in the respondent no.2/society. The petitioner further seeks appointment of an Administrator for respondent no.2/society.

Learned counsel for the petitioner states that reports have been filed by three different Administrators-cum-Returning Officers stating that there is embezzlement of society funds by the erstwhile Managing Committee and sought an enquiry into the affairs of the society. the complaints filed by the residents and reports of the Administrators-cumReturning Officers, the respondent no.1 issued a show cause notice dated 1st November 2023, but no conclusive action has been taken so far. 3.

He states that due to misappropriation, petitioner stopped payment of maintenance and issued a letter dated 4th April 2024. He further states that the respondent no.2/society has stopped basic amenities like plumber, electrician, generator backup, garbage dumping etc. of the petitioner on the pretext of non-payment of maintenance since June, 2023. 4.

Since, the respondent no.1 is already cognizant of the complaints made by the residents and reports filed by the Administrators, no further directions are required to be issued. However, the respondent no.1 is directed to expedite the disposal of the complaints filed by the petitioner in accordance with law.

Petitioner is directed to pay the outstanding maintenance amount to the respondent no.2/society without prejudice to her rights and contentions. 6.

With the aforesaid directions, the writ petition alongwith pending applications stands disposed of.
