The present petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarika Suraksha Sanhita, 2023 has been filed by the Petitioner-mother seeking production of her specially-abled daughter, who is approximately 15 years of age. 3.
It is the case of the Petitioner that her daughter has gone missing from the night of 12th September, 2024. The FIR No.470/2024 regarding the same has been registered at the Police Station Govind Puri upon the complaint of the present Petitioner. It is also noticed from the record that there are two POCSO cases which have been filed, wherein, the missing girl is the complainant and those cases are still pending adjudication. 4.

transferred to Anti-Human Trafficking Unit ('AHTU') Crime Branch to take steps for tracing the minor girl along with investigation records. 5.
On 17th November, 2024, a status report had been filed by the State as per which out of the two suspects (accused persons facing trial in two separate FIRs registered in respect of Ms. 'X'), Yakub is in judicial custody and, the other suspect, Sahil is released on bail. Further, in respect of the missing girl it was stated that a local enquiry revealed that one of the persons from the neighbourhood had seen Ms. X in Gali no. 23 at around 03- 03:30 PM on 12th September, 2024 and she was alone at that time. Accordingly, the AHTU was stated to have been conducting searches in various shelter homes including Nari Niketan, Apna Ghar Ashram etc.

On the last date i.e., 14th January, 2025, the Court was informed by the State that some lead has been received in respect of the missing girl and further investigation would have to be carried out in Bihar. Accordingly, the Court had directed that the same be done and the missing girl be produced on the next date.

A further status report dated 17th February, 2025 has been handed over in Court and the same is taken on record. As per the said report, the lead which the police had earlier discovered was also investigated and one boy was found who was the missing girl's brother's friend. The said boy has informed the police that he was only following the Instagram of the missing girl as he was the friend of her brother. Therefore, there has been no further progress in this investigation.

In view of the above, let the investigation continue in a diligent manner and the status report be filed every three months before the concerned Magistrate.

The progress in the investigation shall be periodically informed to the Petitioner. If the Petitioner receives any further information, she may contact the concerned Investigating Officer and provide the said information to enable further investigation in this case.
