Writ Petition has been filed under Article 226 & 227 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, to quash FIR bearing No. 315/2024, u/s 25 Arms Act registered P.S IGI Airport and all consequential proceedings emanating therefrom.

As per the prosecution, while the Petitioner was traveling from Delhi to Kathmandu on 29.04.2024, 06 live ammunition's mark (7.65 KF) were detected from his handbag. The Petitioner in his disclosure had stated that he had gone to attend the wedding of his sister of his friend and someone may have put it in the bag, about which he is not aware. 3.

Today, learned Counsel has argued that he had borrowed the bag from his neighbor and maybe the ammunition belonged to him. There are contradictory explanations forthcoming.

of any person to explain the ownership of these cartridges. 5.

In these circumstances, no case made out for quashing of the FIR. 6.

The Petition is hereby dismissed.
