The instant application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the petitioner/applicant seeking modification of paragraph no. 87 of the order dated 28th January, 2025 passed by this Court to the extent that the period of surrender be extended to either for 15 days or till the date of listing of SLP before the Hon'ble Supreme Court. Paragraph no. 87 of the order dated 28th January, 2025 reads as under:
"87. The applicant, if on interim bail, is directed to surrender before the Court concerned within a period of seven days from today and the sureties/bail bond, if any shall stand discharged. If the applicant fails to surrender as directed, the investigating agency shall take appropriate steps to take the applicant in custody to secure his presence."

Learned counsel appearing on behalf of the applicant submitted that vide the order dated 28th January, 2025, the applicant's bail application was dismissed by this Court and the applicant was directed to surrender within a period of seven days. It is submitted that the applicant has preferred a Special Leave Petition bearing SLP (Criminal) No.1678/2025 before the Hon'ble Supreme Court challenging the order dated 28th January, 2025 passed by the this Court, however, the same has not been listed yet and the period of surrendering is expiring today.

Learned counsel appearing on behalf of the applicant further submitted that he is not pressing the instant application on merits, however, it is prayed that the period of surrender may be extended as he is not able to surrender today, i.e., on 3rd February, 2025, in terms of the directions passed by this Court vide order dated 28th January, 2025. 4.

Mr. Manish Jain, learned Special Counsel for ED appearing on advance notice accepted notice and vehemently opposed the instant application.

Since the instant application has not been pressed on merits and taking into consideration the submission of learned counsel for the applicant that due to some difficulty the applicant is unable to surrender today as well as in the interest of justice, the time period to surrender is hereby extended. 7.
Accordingly, the applicant is directed to surrender before the Court Concerned on or before 10th February, 2025 by 4:00 PM and upon surrendering, the sureties/bail bond, if any shall stand discharged.
