By way of the present application, the petitioner/applicant seeks regular bail in FIR No.
0126/2023 registered under Sections 420/468/471/389/170/120B at P.S. Special Cell, Delhi. 2.
Learned APP for the State has taken a preliminary objection to the entertainability of the application as the earlier bail application was dismissed vide a detailed order dated 16.04.2024, a copy of which has not been placed on record alongwith the present application. 3.
Learned counsel for the applicant/petitioner submits that though copy of the order dated 16.04.2024 has not been filed, but the factum of dismissal has been mentioned in the petition. It is further stated that after the dismissal of the bail application of the present applicant, one co-accused namely, Vishesh Aggarwal has been admitted to bail by this Court vide order dated The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. 27.08.2024 passed in BAIL APPLN. 2803/2024. According to the learned counsel for the applicant, the same has resulted in change of circumstances and therefore, he seeks parity on the ground of bail granted to co-accused Vishesh Aggarwal.

Mr. Khanna, learned APP for the State, on the other hand, while maintaining the preliminary objection, has drawn the attention of this Court to the fact that the co-accused Vishesh Aggarwal was admitted to bail on the ground that only material cited against him was the disclosure statement of one Diwan Afzal. There was no other material against the said co-accused. 5.
I have heard the learned counsels for the parties and after having gone through the previous order passed in the earlier bail application of the applicant as well as the order of the co-accused, I find no ground to entertain the present application.
