% 30.05.2016 I.A. No. 6967/2016 This application has jointly been moved by the parties to record their settlement under Order XXIII Rule 3 CPC.

At the outset, learned counsel for the plaintiff states that the suit may be dismissed as withdrawn in respect of defendants No.1 to 5. It is ordered accordingly.

The application has been signed by the plaintiff and defendant No.6 as also the learned counsel for the said parties. It is also supported by affidavit of Ms.Usha Rani Oberai, the plaintiff and Mr. Ajay Thukral, defendant No.6. The parties have also placed on record the settlement deed/

memorandum of understanding arrived at between them dated 04.05.2016. The terms of settlement appear to be fair, just and reasonable and there is no impediment in accepting the same.

Accordingly, the suit stands disposed of in terms of the said settlement arrived at between the parties. The parties shall continue to remain bound by the same.
