This is a petition filed under section 9 of the Arbitration and Conciliation Act, 1996 read with section 6 of the Commercial Courts Act, 2015 seeking the following reliefs against the respondent:- "a) Pass an ad-interim ex-parte order directing the Respondent to immediately restore and ensure uninterrupted supply of electricity, water and all other essential utilities to the Leased Premises i.e. "Playboy, measuring Super Area 7205 sq. ft., located at The Grand Hotel, New Delhi, so as to enable the Petitioner to carry on its lawful business operations till the disputes between the parties are adjudicated by the Ld. claiming through or under it, from in any manner interfering with or disturbing the peaceful possession and enjoyment of the Leased Premises by the Petitioner till the disputes between the parties are adjudicated by the Ld. Arbitral Tribunal, without due process of law;" 2.

The reason for filing the present petition is predicated on the fact that the respondent had disconnected the supply of electricity and water to the leased premises i.e. The Playboy Restro Bar/Lounge in The Grand, Nelson Mandela Road, Vasant Kunj, New Delhi - 110070. 3.

Mr. Sibal, learned Senior Counsel appearing on behalf of the respondent states that respondent has never disconnected the same. 4.

Since the electricity and water supply were never disconnected, Mr. Dhawan, learned Senior Counsel appearing on behalf of the petitioner, on instructions, does not press the present petition. 5.

For the said reasons, the present petition is disposed of leaving the parties to avail of all their legal rights, as and when the situation so arises.

As the petition is disposed of, the interim order dated 03.09.2025 stand vacated.
