O R D E R
% 03.03.2016 C.M. Appl. No.5641/2016 This is a joint application under Section 151 CPC for recording settlement arrived at between the petitioner and respondents. Learned counsel for the petitioner submits that the memorandum of settlement has been executed on 11.02.2016 whereby the petitioner has agreed to pay 50% wages of 20 employees w.e.f. 01.04.1999 to 10.05.1999 and 01.04.2000 to 01.07.2000 which comes to Rs.1,00,000/- (Rupees One lakh) and the said amount shall be deposited by the petitioner in the name of Registrar General of this Court.
Learned counsel for the petitioner further submits that the petitioner has prepared a bankers cheque of Rs.1,00,000/- (Rupees One lakh) in terms of settlement and the petitioner shall deposit the same with the Registrar General of this Court within two days from today.
Mr.
Mahesh Srivastava, learned counsel for respondents, on instructions, submits that the parties have already settled the matter. Mr. Narain Singh, General Secretary of Hindustan Engineering & General Mazdoor Union stated that memorandum of settlement has been executed and he also submits that the petitioner will deposit Rs.1,00,000/- (Rupees One lakh) towards full and final settlement of award dated 24.01.2005 passed by learned Presiding Officer, Karkardooma Courts, Delhi.
In view of the submission made by counsel for the parties, joint application under Section 151 CPC and Memorandum of Settlement, the award dated 24.01.2005 stands satisfied.
However, the petitioner shall deposit the amount in terms of settlement within 3 days from today and the said amount be released in the name of Hindustan Engineering General Mazdoor Union through its General Secretary subject to filing an undertaking that the said Union will disburse the said amount as per settlement, whose names are mentioned in para 2 of the memorandum of settlement.
The litigation expenses deposited by the petitioner be also released to respondent No.1, Hindustan General Mazdoor Union. The application stands disposed of.
