Representation for grant of upgraded grade pay and grant of nonfunctional selection grade (NFSG) has been remitted back by second respondent to first respondent on 22nd August 2017 with a direction to take action in terms of Services' Department letter of 19th January, 2016 and circular dated 21st October, 2016 whose copies have been enclosed with the aforesaid Communication.

The grievance of petitioners is that despite the aforesaid Communication of 22nd August, 2017, petitioners have not been granted the upgraded grade pay and non-functional selection grade. 3.

Despite service of advance notice on contesting respondent No.1, W.P.(C) No.2032/2018

none appears on its behalf.

In the facts and circumstances of this case, it is deemed appropriate to dispose of this petition with direction to first respondent to pass effective orders in terms of aforesaid Communication of 22nd August, 2017 within a period of six weeks and if it is not done within the above stipulated time, then the reasons be spelt out and petitioner be intimated about it within a week thereafter, so that petitioner may avail of the remedy as available in law, if need be.

With aforesaid directions, this petition and the application are disposed of.
