This writ petition has been preferred on behalf of the Petitioner seeking quashing of Notification dated 02.09.2024 whereby Respondent No.1/Jawaharlal Nehru University has constituted an Inquiry Committee to investigate the complaint made by Respondent No. 2 against the Petitioner for an alleged misbehaviour on 28.08.2024 as well as for a direction restraining Respondents No. 1, 3 to 7 from proceeding further with the inquiry.

At the outset, learned counsel for the Petitioner submits, on instructions, that Petitioner has no objection to the Inquiry Committee investigating/inquiring into the false and frivolous allegations levelled against him by Respondent No.2, since Petitioner is completely innocent, however, the grievance is that Respondent No. 1 has taken no steps to initiate an inquiry into the complaint made by the Petitioner on 28.08.2024 against Respondent No. 2 and Petitioner is being treated unfairly. 7.

Mr. Vasanth Rajasekaran, learned Senior Standing Counsel appearing on behalf of Respondent No. 1 submits that there is no bias against the Petitioner and the Inquiry Committee will conduct the inquiry in a fair and transparent manner. Insofar as the complaint made by the Petitioner is concerned, it is submitted that the same will also be looked into. 8.

Accordingly, this writ petition is disposed of with a direction to Respondent No.1 to examine the complaint dated 28.08.2024 made by the Petitioner since Respondent No.1 is expected to treat all its employees equally and apply the same yardstick. Court is sanguine that the Inquiry Committee(s) will act fairly and give opportunity of hearing to the Petitioner and Respondent No. 2 to present their respective stands with respect to both the complaints.

No further order is required to be passed in this writ petition. Pending application stands disposed of.
