This is an application under Section 151 CPC filed on behalf of the petitioner seeking recording of statement and dismissal of writ petition.

Learned counsel for the petitioner submits that during the pendency of the writ petition, without going into merits of the claim or otherwise, the petitioner has agreed to withdraw the present petition and the respondent management has also agreed to compensate the petitioner for the expenses incurred in continuing of legal proceedings by paying the amount of Rs.50,000/- in lump sum vide D. D. No. 016437 dated 08.11.2017 drawn on IDBI Bank, Karol Bagh Branch, New Delhi towards the full and final settlement.

Learned counsel for the petitioner on instruction, submits that there is no dispute pending between the parties and nothing is due from the respondent and that the petitioner be permitted to withdraw the present petition.
