Present petition has been filed seeking issuance of directions to DRAT, Delhi to urgently take up the matter bearing Appeal no. 360/2023. 2.

Learned counsel for the petitioner states that on 27th October 2023, the petitioner filed a Regular Appeal No. 360/2023 challenging the order dated 9th March, 2010 passed by DRT-I, Delhi in O.A. No. 13/2007 whereby a recovery certificate has been issued against the petitioner herein and two other borrowers for a sum of Rs.55,17,749/- alongwith pendente lite and future interest @14% per annum from 19th January, 2007 till its realization in full.

He states that the appeal was listed for the first time on 17th November, 2023. He further states that on 30th November, 2023, the petitioner filed an application for early hearing and made the requisite predeposit of 15 lakhs. He states that subsequently, the matter has been listed on various dates, however, the same has not been heard till now and the next date in the matter is 3rd October, 2024.

Keeping in view the aforesaid, the present petition is disposed of with a direction to the DRAT to hear the applications filed by the petitioner on the next date of hearing i.e. 3rd October 2024. 5.

The rights and contentions of all the parties are left open.
