The present petition was filed by the State wayback in the year 2014, challenging the impugned order dated 19.12.2013 passed by learned District & Sessions Judge (West), Delhi, whereby, the respondent was discharged of the alleged offences. 2.
It is pointed out that the charges under Section 302/397/34 of the Indian Penal Code 1860 and Section 25 read with Section 27 of the Arms Act 1959, were, however, framed against the main accused Pradeep Mittal.

It is not disputed that the accused Pradeep Mittal against whom there are direct allegations of committing the offence, has already been acquitted pursuant to the trial. The judgment of acquittal of the main accused has not been challenged by the State.

It is also not disputed that pursuant to the acquittal of the co-accused Pradeep Mittal, no purpose would be served by passing any order in the present petition as the same has become infructuous.
