+ BAIL APPLN. 465/2018 RAM KISHORE GARG & ORS.

..... Petitioners Through Mr.Vijay Jatav, Adv.

versus THE STATE GOVT OF NCT OF DELHI ..... Respondent Through Ms.Manjeet Arya, APP.

SI Nirmala PS Shakarpur.

Mr.M.Shamikh, Adv. for complainant.

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 10.07.2018 Petitioners are the parents and married sister of Pankaj Garg, against whom complainant has levelled allegations of committing rape right from July, 2010 to December, 2017. They have prayed for grant of anticipatory bail to them. It is contended that main allegations are Mr.Pankaj Garg and petitioners have been unnecessarily roped in. Learned APP, who is assisted by learned counsel for the prosecutrix, submits that Pankaj Garg had extorted `3 lacs by blackmailing the prosecutrix.

Pankaj also promised to marry the complainant but subsequently declined and got married to someone else on 28.11.2014,

without informing the complainant.

Learned counsel for the prosecutrix, however, submits that the application of petitioners, who are parents and married sister of Pankaj Goel, is not being opposed.

Keeping in mind the totality of facts and circumstances of this case, it is ordered that in case of arrest, petitioners be released on bail, subject to each of them furnishing a personal bond in the sum of `20,000/-(Rupees Twenty Thousand Only) with one surety each of the like amount to the satisfaction of the Investigating Officer/Arresting Officer/SHO concerned. Petitioners shall, however, cooperate in the investigation and appear before the Investigating Officer as and when they are called upon to do so. Bail application is disposed of in the above terms. Dasti.
