Petitioner (defendant in suit) has assailed order dated 28.07.2025 of the learned trial court whereby, application for recording evidence in court instead of through the local commissioner was dismissed after observing the conduct of the defendant.

On being pointed out that the foundational order appointing the local commissioner to record evidence was dated 29.04.2025, which is not under challenge in the present petition, learned counsel for petitioner seeks permission to withdraw this petition with liberty to institute appropriate proceedings in accordance with law.

Accordingly, the petition and accompanying applications are dismissed as withdrawn with liberty as sought.
