O R D E R

By the present petition, the petitioners challenge the order dated 28.08.2025, passed by the learned Judicial Magistrate First Class (JMFC) in Ct Cases 44239/2016.

By order dated 07.08.2025 passed by the learned JMFC, the petitioners' right to address final arguments was closed. 3.

The said order was challenged by the petitioners before the learned Court of Sessions, however, due to the advocates abstaining from work, the petition could not be taken up before the learned Court of Sessions.

The petitioners have approached this Court since the learned JMFC by order dated 28.08.2025 has listed the matter on 11.09.2025 for passing the final judgment.

The petitioners essentially want one date for addressing oral arguments.

The learned counsel for the respondent, who appears on advance service, points out that multiple adjournments were taken by the petitioners.

He submits that the matter was listed for the first time in the month of January, 2025 for final arguments and the petitioners' right to address arguments was finally closed by the order dated 07.08.2025 passed by the learned JMFC, on account of the repeated adjournments taken by the petitioners. 8.

Be that as it may, not much time has elapsed since 07.08.2025 when admittedly, the petitioners were allowed to address arguments. The delay caused can be compensated by putting the petitioners to cost and putting strict terms. 9.

In view of the above, the present petition is allowed and the order dated 07.08.2025, passed by the learned JMFC in Ct Cases 44239/2016 is set aside.

The learned counsel for the petitioners' submits that the matter is listed before the learned JMFC on 11.09.2025 and subject to the advocates being permitted to appear, he will address final arguments on the said date itself and will not seek any unwarranted adjournment. He submits that the arguments will be addressed in one day itself.

The petitioner is directed to pay a cost of ₹40,000/- to the respondent. The learned Trial Court is requested to make endeavour to conclude arguments on 11.09.2025 itself. 12.
