A Petition under Section 482 Cr.P.C has been filed for quashing of FIR No.557/2018 under Section 323/342/354B/452/506/509/34 IPC registered at P.S .Mehrauli and the consequential proceedings, on the ground that the complainant/respondent No.2 has died on 21.04.2021 due to breath related complications. The case is at the pre-trial stage before the learned M.M and the statement of respondent No.2/complainant has not been recorded or subjected to cross-examination. In view of the facts a prayer is made that the FIR along with the consequential proceedings be quashed. 2.

The State has given a Status Report confirming the demise of the complainant Smt. J. on 21.04.2021 and the Death Certificate has also been annexed along with the Status Report, which may be taken on record. 3.

In case the FIR registered on the basis of the complaint made by Late Smt. J does not survive any more, the prayer needs to be made before the learned M.M. before whom the matter is pending. 5.

There is no ground for quashing of the FIR. The petition is hereby dismissed with liberty to the petitioner to approach the Trial Court for appropriate relief.
