Mr. Nirmal Mishra, learned counsel for respondent Nos. 2 to 4 - National Building Construction Corporation Limited ["NBCC"], raises a preliminary objection that NBCC is a notified entity under the Administrative Tribunals Act, 1985.

In these circumstances, Mr. Dhiraj Kumar, learned counsel for the petitioner, seeks permission to withdraw the present petition, with liberty to approach the Central Administrative Tribunal on the same cause of action.

The petition, alongwith the pending application, is dismissed as withdrawn, with liberty as aforesaid.
