The present writ petition has been filed by the petitioners, who are residents of Block-C, Acharya Niketan Road, Mayur Vihar Phase-1, New Delhi-110019, seeking directions to the respondent/MCD to remove the illegal encroachment.

It is submitted that the petitioners have been facing encroachment and illegal activity in Block-C, Acharya Niketan Road, Mayur Vihar Phase-1, New Delhi-110019, for the last three years, and the same is growing rapidly. 3.

Counsel appearing on behalf of the petitioners submits that the various shopkeepers in the area in question, have encroached upon land outside their shops. Status report has been filed on behalf of the respondent/MCD on 18th November, 2025, wherein it is stated that action was taken by MCD on 17th October, 2025, 12th November, 2025 and 15th November, 2025. 5.

In light of the submission of the counsel for the petitioner that encroachments have surfaced again, the respondent/MCD was directed to file a fresh action taken report.

A fresh status report has been filed on behalf of the respondent/ MCD on 15th April, 2026. Paragraph no. 4 of the said status report is set out below: 7.

A status report has also been filed on behalf of the respondent no. 2/ Delhi Police, wherein it is stated that various FIRs have been registered for encroachment on public way in Acharya Niketan Marg and encroachment removal programs have also been conducted.
