O R D E R

% 06.11.2015 Crl. M.A.16404/2015 By the aforesaid application, the petitioner has sought modification of the order dated 16.03.2015 passed by Hon'ble Mr. Justice A.K. Pathak in W.P.(CRL) No. 297/2015 whereby the petitioner was directed to be released on parole for a period of 30 days from the date of his release, subject to his furnishing a personal bond in the sum of Rs.10,000/- with one surety of the like amount to the satisfaction of the Jail Superintendent. Certain conditions were also imposed on the petitioner after his release on parole. It has been submitted on behalf of the petitioner that because of poverty, he could not avail of the order. The petitioner because of his stringent financial circumstances, could not furnish bond in the sum of

Rs.10,000/.- It is, therefore, prayed that the order be modified and the condition of surety amount be reduced from Rs.10,000/- to Rs.5,000/-. Considering the poverty of the petitioner and the fact that order of grant of parole could not be availed by him because of his poverty, this Court is inclined to modify the order dated 16.03.2015. Let the petitioner be released on parole for a period of one month from the date of his release, subject to his furnishing a bond in the sum of Rs.5,000/- with one surety of the like amount to the satisfaction of the Trial Court.

The conditions which were imposed on the petitioner by order dated 16.03.2015 shall subsist.

The application is allowed and disposed of accordingly. Copy of the order be sent to the Jail Superintendent for intimation and compliance.
