The present petition under Section 11 of the Arbitration and Conciliation Act, 1996 ('A&C Act') has been filed by the Petitioner seeking appointment of an independent sole arbitrator to adjudicate the disputes between the parties.

Attention of this Court has been drawn to the Order dated 20.09.2024, passed by the NCLAT in an appeal filed by the Respondent herein against the Order dated 11.09.2024, passed by the NLCT, admitting an application under Section 7 of the IBC against the Respondent herein. 3.

In view of the fact that application under Section 7 of the IBC has been admitted and Corporate Insolvency Resolution Process has been initiated and Moratorium under Section 7 has set in and the Petitioner cannot make any claims against the Respondent herein, learned Counsel for the Petitioner seeks permission to withdraw the present Petition with liberty to approach this Court once again with the same prayers after the disposal of the appeal filed by the Respondent herein by the NCLAT.
