This Petition has been filed under Section 11(6) of the Arbitration and Conciliation Act, 1996 seeking appointment of an Arbitrator to adjudicate the disputes between the parties.

Material on record indicates that this Court vide Order dated 22.11.2023 passed in ARB.P. 1119/2023 had appointed Mr. D.N. Ray, Advocate as Arbitrator to adjudicate on the dispute between the parties. Since the Ld. Arbitrator had been recommended for appointment by the Hon'ble Supreme Court as Judge of the High Court of Gujarat, the Ld. Arbitrator vide email dated 20.08.2024 has expressed his inability to continue with the arbitration proceedings.

In view of the above, this Court is inclined to appoint Suruchi Aggarwal, Senior Advocate (Mobile No. 9312631490), as the Sole Arbitrator to continue with the arbitration proceedings. 6.

The Petitioner is directed to collect the arbitral records from the office of Ld. Arbitrator - Mr. D.N. Ray, Advocate, and place the same before Ld. Arbitrator - Suruchi Aggarwal, Senior. Advocate. 7.

The Ld. Arbitrator - Suruchi Aggarwal, Senior. Advocate is directed to furnish the requisite declaration required under Section 12 of the Arbitration and Conciliation Act, 1996. The Ld. Arbitrator can fix fees in accordance with the Arbitration and Conciliation Act, 1996. 8.

With these observations, the petition is disposed of, along with pending application(s), if any.
