An application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ('BNSS') has been preferred on behalf of petitioner for grant of regular bail in FIR No. 292/2023 under Sections 392/397/34 IPC & Sections 25/27/54/59 of Arms Act registered at P.S. Nangloi. Chargesheet has been filed under Sections 392/395/397/411/120B/34 IPC & Sections 25/27/54/59 of Arms Act .

Issue notice. Learned APP for the State appears on advance notice and accepts notice.

Learned counsel for the petitioner submits that since IO has not been appearing before the learned trial court, the case is pending at the stage of charge for over a period of one year. application without prejudice to the rights and contention of the petitioner. 4.

Taking the statement of learned counsel for petitioner on record, application is accordingly disposed of without expressing any opinion on the merits of the case.

Considering the facts and circumstances of the case, learned Trial Court is also directed to make an endeavour to hear the arguments on charge on the next date of hearing fixed before the learned trial court. IO is also directed to appear before the learned Trial Court, as prayed on behalf of learned counsel for petitioner.

Pending applications, if any, also stand disposed of. A copy this order be forwarded to the learned Trial Court for information and compliance.
