By way of the present application, the petitioner/applicant seeks regular bail in FIR No.58/2024 registered under Sections 308/506/34 IPC at P.S. Ranhola, Delhi.

Learned counsel for the applicant submits that the applicant has been in custody since 09.05.2024 and the chargesheet has been filed pursuant to which charges have been framed. He further submits that the applicant is no longer required for any custodial interrogation. It is further submitted that the incident occurred on account of brawl that took place on the intervening night of 14.01.2024 and 15.01.2024 for the reason when two persons in a drunken state started urinating on the road facing the applicant and his wife. When the incident was objected to, it led to passing of derogatory remarks against the applicant's wife. It is stated that even the applicant and his wife suffered injuries and a cross FIR has also been registered. 3.
Learned APP for the State has opposed the present bail application. He submits that the victim has suffered grievous injuries on the right frontotemporo-parietal region for which the victim has been operated twice. It is stated that the victim is suffering from Hemiparesis and still has left sided weakness of the upper and lower limb.

I have heard learned counsel for the applicant as well as learned APP for the State and have also gone through the material placed on record. The incident occurred on the intervening night of 14.01.2024 and 15.01.2024. It is alleged that the applicant has caused injuries on the head of the victim. There is also a cross FIR lodged by the present applicant wherein the present complainant is an accused and it has been alleged therein that the applicant and his wife also suffered injuries on their head at the behest of the complainant and his people.

Considering the facts and circumstances of the case and the period of custody as well as the fact that the chargesheet stands filed, it is directed that the applicant be released on regular bail, subject to his furnishing a personal bond in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of the concerned Jail Superintendent/ concerned Court/Duty J.M. and subject to the following further conditions:- i) The applicant shall not leave the NCR without prior permission of the concerned Court.

iii) In case of change of residential address or contact details, the applicant shall promptly inform the same to the concerned Investigating Officer as well as to the concerned Court. iv) The applicant shall not directly/indirectly try to get in touch with the complainant or any other prosecution witnesses or tamper with the evidence.
v) The applicant shall regularly appear before the concerned Court during the pendency of the trial.

The bail application is disposed of in the above terms. 7.
Copy of the order be communicated to the concerned Jail Superintendent electronically for information and compliance. 8.
Copy of the order be uploaded on the website forthwith. 9.
Needless to state that nothing observed hereinabove shall amount to an expression on the merits of the case and shall not have a bearing on the trial of the case as the same has been expressed only for the purpose of the disposal of the present bail application.
