% 13.09.2025 Appellant insurance company has filed an appeal for reduction of the award finally modified vide dated 05.01.2016 passed by the Learned MACT, awarding a compensation of Rs. 23,87,012/- along with interest @ 9% p.a. from the date of filing of claim petition or DAR whichever is earlier.

On appeal, the insurance company was directed to deposit entire awarded amount with up to date interest in terms of the order dated 21.09.2016 passed by this Hon'ble Court and it is confirmed by Officer of Insurance Company that the said amount is deposited before the Registrar General, Delhi High Court and 50% of the awarded amount was directed to be released.

We have interaction with the Ld. Counsel for the Appellant, it is submitted on instruction that the Ld. Counsel for the Appellant wishes to withdraw the appeal.

In view of above, it is directed that the balance amount lying deposited before the ld. Registrar General, along with accrued interest, if not released, be directed to be released to the Respondent /Claimant(s) in terms of the award of the Tribunal. It is further directed that the statutory amount with interest if any, be refunded to the Insurance Company.

In terms of the aforesaid, the present appeal along with pending application (s) stand disposed of with directions in terms of the settlement.

A copy of this order be sent to the concerned learned Tribunal with TCR, if already received.
