O R D E R

The present proceedings are instituted on behalf of the petitioners seeking quashing of FIR No. 332/2024 registered under Sections 324/34 IPC at P.S. Palam Village, Delhi on the ground that the parties have amicably settled their disputes.

As per the allegations levelled in the FIR, an altercation broke out between the petitioner No.1/complainant and petitioner Nos. 2 to 6/accused persons, wherein the petitioner No.1 was injured. 3.

Learned APP for the State, on instructions, submits that the petitioner Nos. 2 to 6 are the only accused persons and petitioner No.1 is the complainant/victim in the present case. He further submits that the FIR is pending investigation and the charge-sheet is yet to be filed. It is also submitted that though the parties have amicably settled the matter, some cost may be imposed upon the accused persons since the State machinery has already been put in motion.

petitioner No.1 and the accused persons/petitioner Nos. 2 to 6 are known to each other. It is further submitted that the present FIR was registered due to some misunderstanding and with the intervention of family members and friends, the parties have amicably settled their disputes vide Settlement Agreement/Compromise Deed dated 24.09.2024, a copy of which has been placed on record. In terms of the said settlement, the complainant/petitioner No.1 is now left with no claims or grievances against the accused persons/petitioner Nos. 2 to 6.

The complainant and accused persons, who have joined through VC, have been identified by their counsel as well as by the I.O./S.I. Vinod, P.S. Palam Village, Delhi. The accused persons have shown remorse for their conduct and undertake to not repeat the same in future. 6.

The complainant/petitioner No.1 states that he has entered into the aforesaid settlement with the accused persons/petitioner Nos. 2 to 6 out of his own free will, volition and without any coercion. He further states that he has no objection if the present FIR and consequent proceedings are quashed. 7.

The parties shall remain bound by the statements made in Court today.

In view of the above facts and considering that no useful purpose will be served in continuance of the proceedings, it is directed that the aforesaid FIR and the consequent proceedings arising therefrom are hereby quashed, subject to the payment of Rs.1,000/- to be paid by each of the petitioner Nos. 2 to 6 to petitioner No.1/complainant by way of a demand draft through the I.O.

Proof evidencing receipt of deposit shall be filed with the I.O., failing which, the I.O. shall be at liberty to move appropriate application. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
