Counsel for the appellant rightly states that the respondent/defendant only claimed tenancy from Sh.Bidhu Ram, and the order passed by a Division Bench of this Court dated 10.7.2006 in this appeal shows that the respondent/defendant has stated that she has vacated the suit property and handed over possession to Sh. Bidhu Ram and therefore was not interested in the subject matter of the suit, and therefore since now the appellant/plaintiff has already filed a suit against Sh. Bidhu Ram, this appeal be disposed of as not pressed with the observations that all issues will be decided in the suit which is filed by the appellant/plaintiff against Sh. Bidhu Ram, and which suit is pending before the Court of Sh. Vishal Singh, ADJ, Central District, Tis Hazari Courts, Delhi, being Suit No. 614671/2016. RFA 286/2006

Therefore, this appeal is disposed of as not pressed and it is observed that all issues with respect to right, title and interest in the suit property as between the appellant/plaintiff Sh. Sohan Lal and Sh. Bidhu Ram will be decided in the said Suit No. 614671/2016 which is pending before the Court of Sh. Vishal Singh, ADJ, Central District, Tis Hazari Courts, Delhi.
