There is no explanations of certain critical facts in the pleadings in the appeal; counsel seeks leave to withdraw the appeal with liberty sought to file an appropriate appeal afresh; which is granted. 2.

The appeal is dismissed as withdrawn.

Money deposited by the appellant in this Court pursuant to order dated May 05, 2015 shall be paid to the respondent together with accrued interest thereon by the Registry.
