Mr.Saurabh Chadda, Adv.

versus NEW DELHI MUNICIPAL COUNCIL AND ANR...... Respondents Through:

Ms.Kanika Agnihotra, Standing Counsel with Mr.Preet Oberoi & Mr.Rudresh Jagdale, Advs. for R-1 to 3.

CORAM:

HON'BLE MS. JUSTICE REKHA PALLI

O R D E R

% 09.03.2018 Learned counsel for the petitioner submits that aggrieved by the action of respondent Nos.1 to 3 in granting licence to respondent No.4 for running 'Licensable Trade of Selling Cooked Food without Preparation', the petitioner has made various complaints which have remained unanswered. He submits that as per the petitioner, the grant of said licence to respondent no.4 is contrary to all the regulations and guidelines of respondent Nos.1 to 3.

Learned counsel for the petitioner submits that at this stage, he would be satisfied, if the respondents are directed to decide his representations by passing a reasoned and speaking order within a time bound manner. He, however, submits that since the petitioner

has made various representations, he may be granted liberty to file a comprehensive representation.

Ms.Kanika Agnihotri, Advocate who appears on advance notice for the respondent does not oppose the said prayer. Upon the petitioner making a fresh representation within one week, the respondents are directed to dispose of the same by passing a reasoned and speaking order, within six weeks thereafter. Needless to say that the said order has been passed, without prejudice to the rights and contentions of both the parties. In case, the petitioner is aggrieved by any order passed by the respondents, he will be entitled to take legal recourse as permissible under law.

The petition is disposed of in the above terms. The pending applications also stand disposed of.
