After some arguments, learned senior counsel for the appellant on instructions seeks leave to withdraw the present appeal with liberty to avail the impugned order by way of appropriate proceedings as per law. 2.

The appeal, alongwith pending applications, is accordingly, dismissed as not pressed, with liberty as prayed for, making it clear that this Court has not expressed any opinion on the merits of the present appeal and therefore it will be open for the appellant to raise all grounds including grounds raised in the present appeal in any proceedings which they may chose to initiate.
