O R D E R

% 30.10.2018 According to the Status Report filed by the DCP (North), a Closure Report has been filed on 22.10.2018. The report states: The investigation was initially carried out by SHO Satyaprakash of PS Sarai Rohilla, Delhi. As the complainant was not satisfied with the investigation conducted in PS Sarai Rohilla, Delhi, hence, the present case was transferred to DIU/North vide order No. 3356-60/SODCP/ North District (AC-V), Dated 29.04.2016 for further investigation by order of DCP/North.

As regards delay on the part of lOs, when substantive and real progress was not made by the lOs to whom this case remained assigned, the detail is follows:-

1. Inspr. Satya Prakash- The than SHO/Sarai Rohilla, who investigated the case from 21.02.2Q16 to 29.04.2016.

2. Inspr. Ram Niwas - The 10, who investigated the case from 03.05.16 to 05.07.16.

3. Inspr. Arun Chauhan- The 10, who investigated the case from 06.07.16 to 05.01.17.

4. Inspr. Dinesh- The 10, who investigated the case from 06.01.17 to 06.04.17.

5. Inspr. Satyabir- The 10, who investigated the case from 07.04.17 to 30.05.18.

As the lOs have been transferred to various other District Unit of Delhi Police. Their misconduct papers have been sent to their present disciplinary authority for taking departmental action against them except the present 10 of the case who concluded the investigation.

In the present case, no evidence surfaced against the suspects and the cancellation report has been filed in the Hon'ble Court of Sh. Chander Mohan, Ld. MM, Court No. 366, Tis Hazari Court on 22.10.18.

The learned counsel for the petitioner submits that there was no complaint by him to the police regarding investigation being carried out by police force or for transfer of the case to any other investigating agency. This aspect may be looked into by the DCP and the conduct of the Officer be followed up as per rules.

No further orders are required at this stage. At this stage, the learned counsel for the petitioner does not press the petition any further. It is disposed off accordingly. NAJMI WAZIRI, J OCTOBER 30, 2018/acm
