No one appears for the appellant. This appeal impugns the judgment of the Trial Court dated 13.07.2006 dismissing the suit for partition by holding that the suit is barred under Section 185 of the Delhi Land Revenue Act, 1954 (DLR Act) because the partition of the suit property will have to take place before the revenue authorities.

In Ground (ix) of the Grounds of Appeal it is stated that land has now been acquired and possibly for this reason this appeal is not being pursued as parties may have received their respective shares on acquisition of the land. 3.
The appeal and the cross-objections are therefore dismissed in default and for non-prosecution.
