% 01.03.2016 After some hearing the learned counsel for petitioner fairly concedes that appeal against the judgment dated 08.05.2009 of the Motor Accident Claims Tribunal with prayer for opportunity to adduce additional evidence under Order 41 Rule 27 CPC would have been the appropriate course. He wants to withdraw the petition seeking liberty to file an appeal with such a prayer. The counsel for the respondent insurance company submits that she has nothing to say. Subject to the contentions of the respondents against the pleadings of the petitioner to be agitated at the appropriate stage, should such an appeal be filed, the present petition is allowed to be withdrawn with liberty as prayed.
