O R D E R

% 09.10.2018 After some hearing, the counsel for the petitioner conceding to the fact that till date the Metropolitan Magistrate presiding over the case arising out of the petition of the first respondent under Protection of Women from Domestic Violence Act, 2005 has not passed any order directing him to pay maintenance allowance or for that matter granting any other relief - permanent or interim, seeks permission, on instructions, to withdraw the present petition, he seeking liberty to raise before the Metropolitan Magistrate the contentions set out in the petition at hand against grant of an order of maintenance allowance in the face of such order having been secured from the Family Court in the proceedings under Section 24 of Hindu Marriage Act, 1956 and in the event of his contentions being rejected or any order passed fastening any additional liability of maintenance on him for him to pursue the appropriate remedies in accordance with law. CRL.M.C. 512/2015
