The present case has remained on the regular board w.e.f. 19th January, 2016. When the matter was taken up on 19th January, 2016, Mr. A.K. Trivedi, Advocate, had entered appearance on behalf of the petitioner and sought time to prepare the brief on the ground that he had been recently engaged, the case was adjourned. In the meantime, the parties were directed to file their brief synopsis, while exchanging the copies with the other side. 2.

When the case was taken up again on 1st February, 2016, learned proxy counsel had appeared for Mr. A.K.Trivedi, Advocate and stated that he had not received any instructions from his client though he had written to him and was awaiting a reply, failing W.P.(C) 13729/2005

which he would seek discharge from the case.

Today, none has appeared on behalf of the petitioner. Ms. Barkha Babbar, learned counsel for the respondents, states that Mr. A.K. Trivedi, Advocate, has informed her that he has not received any instructions from his client though he has written to him. 4.

It appears that the petitioner is not interested in pursuing the present petition.

This petition is accordingly dismissed in default and for non-prosecution.
