Counsel for the respondent/plaintiff states that the impugned judgment and decree granted the relief of specific performance with an alternative relief of payment of the amount of Rs.2,40,000/-. It is stated that the appellants have deposited the amount of Rs.2,40,000/- in this Court, and the respondent is ready to receive the amount deposited along with accrued interest in full and final satisfaction of the claim of the respondent/plaintiff in the subject litigation.

Since no one appears for the appellants, this appeal is dismissed in default and for non-prosecution.

The amount deposited in this Court be released to the respondent along with accrued interest subject to the respondent furnishing an undertaking to this Court that in case this appeal is for some reason restored, and the appeal is allowed, then the respondents will restitute the appellants.
