No one appears for the appellant although it is 2.48 P.M. This case is on the Regular Board of this Court since 22.4.2018 and 3.7.2018. 2.

The challenge by the appeal is to the impugned judgment decreeing the suit of the respondent no.1/plaintiff/bank by passing a decree for a sum of Rs.13.20 lacs alongwith interest. 3.

When notice was issued in this appeal on 18.12.2006, the appellant was directed to deposit the decretal amount but the decretal amount has not been deposited.

This appeal is therefore dismissed in default and for nonprosecution. Let no application for restoration/recall of this order be entertained unless costs of Rs.20,000/- are first paid to the counsel for the respondent no.1.
